Court of Chancery Implements Amendments to Court Rules 178A and 180-B

Chancellor Kathaleen St. Jude McCormick today signed an order adopting amendments to Court of Chancery Rules 178A and 180-B, effective as of June 1, 2026. The amendments are intended to improve the processes in proceedings relating to life-sustaining procedures and to ensure consistency with related statutes.

The Court has issued a commentary to each of the amended rules to provide interpretive guidance for practitioners. These commentaries do not add obligations beyond the rules themselves.

Court of Chancery Implements Third Tranche of Amendments to Court Rules. On May 18, 2026, Chancellor Kathaleen St. Jude McCormick signed an order adopting amendments to Court of Chancery Rules 46, 54 through 65.1, 67, 69 through 72, 77 through 78, 81 through 83, 85 through 88, and 100. This group of amendments is the third installment of a larger effort to update, modernize, and improve the Court of Chancery’s Rules.

In addition to substantive, formatting, and stylistic changes, the Court has issued a commentary to each of the amended rules to provide interpretive guidance for practitioners. These commentaries do not add obligations beyond the rules themselves.

On May 11, 2026, the Delaware Court of Chancery published Guidelines on Attorney Civility intended to preserve the integrity and effectiveness of legal proceedings and practice before the Court, including by maintaining the inveterate tradition of collegiality and professionalism that remains a hallmark of the Chancery bar. The guidelines express the Court’s expectation that attorneys practicing before the Delaware Court of Chancery will adhere to the highest standards of civility, professionalism, and respect in all proceedings, including depositions, hearings, written communications, and interactions with opposing counsel and the Court.
