Initiating a Complaint Against a Delaware Lawyer
Step 1
In order that you understand what it means to file a disciplinary complaint against a Delaware lawyer, please read first "Some Things You Should Know".
Step 2
If you decide that you still want to file a disciplinary complaint, follow the instructions below:
Complete the Complaint Form:
- Fill out the Confidential Complaint Form completely (except "ODC File No.")
- Give the full name of the lawyer about whom you are complaining
- Sign and date the complaint form
Attach a Separate Sheet of Paper to the Complaint Form:
Explain in your own words exactly what your complaint is against the lawyer.
- What type of case does/did this involve? (e.g. personal injury, domestic relations);
- Did the lawyer represent you in the matter?
- When did the representation begin?
- What was your agreement as to the representation?
- Was this agreement in writing? (if so, please attach a copy of the agreement)
- Was there an agreement about fees and costs of the representation?
- Was this in writing? (if so, please attach a copy of the agreement)
- If no writing, what did you understand the fees and costs to be?
- When were you last in contact with the lawyer?
- Have you hired a new lawyer? (if so, please provide that lawyer's name)
PROVIDE COPIES OF ANY LEGAL DOCUMENTS YOU HAVE WHICH RELATE TO YOUR COMPLAINT. PLEASE DO NOT SEND ANY ORIGINAL DOCUMENTS.
Step 3
Once you fill out the complaint form, print it then sign and date the form and mail it with your factual statement(s) by first-class mail.
SEND THE COMPLETED COMPLAINT FORM AND ANY ADDITIONAL INFORMATION BY FIRST CLASS MAIL TO:
