Arbitration in the Court of Common Pleas

What is arbitration?

Arbitration is a method to resolve disputes between parties using a neutral third-party to decide the matter. If your matter is arbitrated, the decision of the arbitrator is non-binding.

Will my case be arbitrated?

If the Plaintiff's claim for relief exceeds $15,000.00, the case will be referred to Arbitration. The Arbitrator receives compensation in the amount of $300.00, which shall be equally shared between the parties. Each party shall pay his or her share to the Clerk of the Court within twenty (20) days of the notice of the appointment of an Arbitrator. (Court of Common Pleas Civil Rule 16.l)

The case will be scheduled for Arbitration once all pleadings have been filed with the Court. Pleadings are the written documents of fact and law that are filed by the parties. Examples of pleadings are the complaint and answer.
