Instructions for Filing a Complaint About the Unauthorized Practice of Law in Delaware


In order to practice law in the State of Delaware, a person must be authorized to do so by the Delaware Supreme Court. The following are general guidelines the Office of Disciplinary Counsel utilizes to evaluate conduct which may be the unauthorized practice of law:

  1. giving legal advice on matters relating to Delaware law;
  2. drafting legal documents or pleadings for use by someone other than himself/herself and not under the supervision of a Delaware lawyer;
  3. appearing as legal counsel for, or otherwise representing, a person or entity (other than himself/herself) in a court or at a governmental agency proceeding;
  4. holding himself/herself out as a Delaware lawyer;
  5. engaging in an activity which has traditionally been performed exclusively by persons authorized to practice law; and
  6. engaging in any other act which may indicate an occurrence of the unauthorized practice of law in the State of Delaware as established by law, statute, ruling or other authority.

Step 1

PROVIDE A WRITTEN STATEMENT.

Explain in your own words exactly what occurred:

  • What type of case does/did this involve?
  • Be as specific as possible. Please provide:
    • names and contact information of the individual(s) you believe have practiced law without authorization;
    • dates when the unauthorized practice of law occurred;
    • under what circumstances the unauthorized practice of law occurred;
    • names of other persons with knowledge that the unauthorized practice of law occurred.

Step 2

PROVIDE COPIES OF ANY LEGAL DOCUMENTS YOU HAVE WHICH RELATE TO YOUR COMPLAINT. PLEASE DO NOT SEND ANY ORIGINAL DOCUMENTS.


Step 3

SEND THE COMPLETED STATEMENT AND ANY ADDITIONAL INFORMATION BY FIRST CLASS MAIL TO:
