WELCOME to the Court of Common Pleas web site. The judges
and the staff are committed to serving the public by providing fair and
efficient proceedings which foster public trust and confidence. Consistent
with this philosophy, this site is designed to give you useful and practical
information about the Court and how to access its services. The Court
of Common Pleas in its present organizational structure can trace its
existence back to the early 1900s, with service to the people of the state
of Delaware.
Presently, the Court consists of nine judges, five in New Castle County,
two in Kent County and two in Sussex County. There is one Commissioner
for New Castle and one shared Commissioner for Kent and Sussex Counties.
It is one of the busiest courts in the State of Delaware exercising jurisdiction
in misdemeanor criminal offenses, traffic violations, civil matters where
the amount in controversy does not exceed $50,000, preliminary hearings
in felony matters and appellate jurisdiction for Justice of the Peace
Court and motor vehicle hearing appeals.
The Court has several problem-solving courts, which consist of a Drug
Diversion Program, a Community Dispute Resolution Program, and a Mental
Health Court. The Court continues to explore ways to deliver services
in the most efficient and cost-effective method.
