     Effective October 24, 2005, the Delaware Supreme Court has begun accepting appeal documents electronically (e-filing) using the Lexis Nexis File and Serve system. The Court is the first appellate court in the nation to require electronic filing using the LexisNexis system which has been the e-filing provider for the Court of Chancery and Superior Court in Delaware. The implementation of the e-filing project will be in phases with the first phase consisting of those civil cases appealed from the Court of Chancery and the Superior Court that were previously e-filed in those courts. Over the remaining phases of the project, all Supreme Court matters will eventually be filed electronically.

Please note: A technology surcharge of 50 cents per document shall be assessed by the Court in each eFile case for the purpose of a fund to operate the eFiling system. The Court shall expend the funds solely for the purpose of operating and maintaining the eFiling system. The technology fee is not imposed on filings by the Arms of the Supreme Court, by the Department of Justice or by indigent parties or their counsel.
